Terms of Service (TOS)

§ 1 Acceptance of Terms

  1. Use of any services of djangoeurope.com constitutes acceptance and agreement to djangoeurope.com's Terms of Service (TOS).
  2. Variations to this Terms of Service are only effective if djangoeurope.com confirms them in written form.

§ 2 Availability

  1. djangoeurope.com aims to provide its services 24 hours a day, 7 days a week without any interruptions. Planned maintenance outages will be announced as soon as possible. Outages will not exceed 10 hours a month.
  2. If outages are longer, a credit will be issued to the customer's account. Its amount is 1% of the monthly fee per exceeded hour, but not more than 100%.
  3. This availability guarantee does not apply to outages which are out of djangoeurope.com's control, like for example upstream network outages or hardware failures.

§ 3 Support

  1. Support is provided by e-mail and the ticket system and is limited to our products.

§ 4 Prohibited Activities

  1. The customer must not perform any activity on our servers that violates international law, Swiss law or any applicable laws at the customer's locality.
  2. The customer must not send unsolicited bulk messages (also known as "SPAM").
  3. The customer must not perform any activities that might put the stability or security of our or other servers at risk. Specifically forbidden is performing of DoS attacks and execution of exploits or other harmful programs.
  4. The customer must not run IRC clients or servers. Port 6667 is blocked on the servers.
  5. The customer must not host erotic or pornographic content.

§ 5 Obligation of the customer

  1. The customer avoids excessive or unnecessary use of system resources or network traffic (fair use). djangoeurope.com reserves the right to limit the network bandwidth or other system resources on excessive usage. More than 200 GB network traffic per month is considered as excessive usage.
  2. The customer ensures not to consume more than 5% processor resources in the hourly average per system user and not to exceed the RAM limit. djangoeurope.com reserves the right to stop ("kill") the affected processes.
  3. The customer may only use ports which are assigned to him/her for incoming connections. Processes which use other ports for incoming connections will be stopped ("killed").
  4. The customer agrees to report noticeable defects immediately to djangoeurope.com.
  5. The customer agrees to check the e-mail address that is given to djangoeurope.com regularly for messages from djangoeurope.com.
  6. The customer is is responsible for backing up his/her data. Although djangoeurope.com performs daily backups on external servers, an accurate recovery of the data is not guaranteed.

§ 6 Cancellation

  1. The ordered services will be automatically renewed by the billing period which was specified
  2. All services will be automatically renewed for the billing period which was chosen by the customer unless previously cancelled.
  3. Cancellation is to be done via the web interface or by registered letter. If the cancellation is done by registered letter, a cancellation period of 7 days applies.

§ 7 Product changes

  1. A product upgrade (e.g. increasing the available space) is performed immediately.
  2. The price difference until the end of the billing period must be paid in advance.
  3. A product downgrade (e.g. decreasing the available space) is performed at the end of the billing period.
  4. If the data on the customer's account approaches the space limit, a warning is issued to the customer. If the space limit is exceeded a warning is issued again. An automatic product upgrade will be performed 14 days after the first warning is sent if the used space is higher than the space limit. In that case, the price difference until the end of the billing period must be paid within 10 days.

§ 8 Payment

  1. All fees must be paid in advance.
  2. Payments must be done via PayPal.
  3. Transaction fees must be paid by the customer.
  4. djangoeurope.com is entitled to disable the services if the customer is in delay of payment.

§ 9 Money-Back Guarantee

  1. The customer must open a ticket within 30 days after account activation in order to use the 30 Days Money-Back Guarantee.
  2. The price for the full billing period will be credited to a PayPal account that can be chosen by the customer.
  3. PayPal transaction fees must be paid by the customer.
  4. djangoeurope.com reserves the right to refuse the money-back guarantee if the customer violated djangoeurope.com's Terms of Service in any way.
  5. djangoeurope.com reserves the right to refuse the money-back guarantee if the customer already had an account with djangoeurope.com.
  6. It may take up to ten business days until a refund request is processed.

§ 10 Applicable law and place of jurisdiction

  1. Solely Swiss law shall apply to the contractual relationship.
  2. The place of jurisdiction is Zurich, Switzerland.
